Mutual concent petition to be filed by husband and wife

My wife is asking for Mutual concent divorce after 8 years. last year she did not appear in her DV and Divorce filed by her and due to which her cases were dismissed for continuous default. How safe is it to file for mutual concent now, that too in a different jurisdiction. I am concerned about the DV and divorce dismissed cases, as she can reopen the same by filing set aside petition and harass me after taking divorce. should i ensure she withdraws the cases before mutual concent filing?

Once the case has dismissed not possible to reopen but in the mutual petition you have mention she cannot go for appeal in dv case and contested case both. Mention each and every thing in the mutual petition and in the order itself officer will mention the same matter. So you have not any risk in future. Once you got mutual divorce you will be free.

Dear Madam, It is true that you have to control your husband on his extra marital affairs. Better to file multiple cases against your husband and his family members to behave themselves within the parameters of the marital life. On the other hand you can also lodge a formal complaint with Police on that woman stating that she is unnecessarily spoiling your family life inviting not only your husband but many other male persons.
