Mutual concent divorce and child Custody

21-Nov-2023 (In Divorce Law)
I don't want to live with my husband because of my in-laws. He is not ready to live seperately. Whenever we fight, he suggests me to get out n leave the baby. What will be legal consequences if I do this?

If you wish to get separated from your husband and your husband is ok with it, you both can go for mutual Divorce by consenting to the terms and conditions finalized by you both. However, if you simply leave your matrimonial home without Divorce, there are no legal consequences as such, but your husband might file a restitution of conjugal rights Petition in family court. My suggestion to you is sort out the matter by discussing amongst yourselves. If not, go for divorce by mutual consent. For further discussion, you can approach me.

Well, if you do not want child, you can handover the Child Custody after giving Mutual Divorce to your Husband if you have become fed up of your Inlaws and if your Husband does not want to live separately with you as per what you have been demanding.
