Mutally Divorce Is Done But FIR Quashing Is Pending Due To Wife

Mutally divorce is done with half paymrent n got the decree also..but as per settlement agreement half payment will be given after quashing of FIR but now wife is not corporating to quashing the FIR...so my first question is that can I re- marriage in that condition wherein half payment n quashing is pending... second question is what r the consequences if FIR is not quash by wife as per the settlement agreement ... In one FIR chargesheet is filed n I got the bail basis quashing will be closed

now a days the courts have taken a strong view in the matter of settled divorce cases where lady revert backs after taking money .in your case your divorce will get completed.for tht you need to hire a good Advocate and he should have a knowledge of present strict laws then your work will.be done

you may quash the petition before the Hon'ble Court on the basis of the settlement agreement which has been mutually and peacefully signed by you and your wife.
Further, if your mutual divorce has already been taken place before the Hon'ble Court, then you may marry again.

if the wife is not filing a quashing petition, you go ahead and file for quashing. In the said petition take the contention that it is a matrimonial dispute and that such settlement terms, as stated above, were agreed upon. there's a good chance that you may get a good order. regarding re-marriage, if your mutual divorce has become final, you can of course get re-married.
