Muslim Husband - 2nd Marriage - Temporary Restraint Order of Injunctio

16-Feb-2023 (In Divorce Law)
An order passed by a Munsiff court, says I am temporary restrained from contracting a second marriage with any other women till next date of hearing 02-03-23. I am Muslim husband from Delhi and married to Muslim women. My wife got this order passed, at the behest of her DV & 125 case. My wife got DV order passed in her favor sometime 3 months ago, I am yet to file objections. It is in objection stage and have requested Hon Judge for some time. My counsel insisted to not pay maintenance as of now and wait for modification order. Pls answer how the restraint order can be challenged?

As such Court shouldn’t restrain you doing second marriage bcoz doing second marriage has nothing to do with our case. It’s your right as per sharia law ! U need to hire expert advocate in this regard ! B in touch

It is a settled law that if a wife refuses to live with her husband then she is not entitled to receive maintenance from her husband. You must contest the orders/ case and there are a plethora of judgments in the husband's favor where the rights of a husband are secured.
