Your present approach is legally risky and requires immediate correction. 1. Non-payment of interim maintenance for 1.5 years is a serious default. The wife is entitled to initiate execution/recovery proceedings, including warrant/attachment. You should immediately clear or seek modification/stay, otherwise adverse orders are likely. 2. Your ex parte RCR decree does not automatically absolve you from maintenance liability. Until set aside or modified, the maintenance order remains enforceable. 3. Instead of merely sending a legal notice, you should file execution of the RCR decree seeking restitution. However, courts are generally reluctant to force cohabitation; practical value is limited. 4. Since the decree is ex parte and recent, the wife may file an application to set it aside. Be prepared to contest that. 5. If she has filed a fresh maintenance case, you must bring on record the existing proceedings and orders to avoid duplication and seek appropriate adjustment/set-off. 6. If you genuinely wish to resume cohabitation, demonstrate bona fides—readiness, separate residence if required, and compliance with court orders. Act promptly: regularize maintenance dues, file appropriate applications, and avoid further non-compliance, as it will seriously prejudice your case.

if the outcome is zero then for ego you are making your advocate to work for you think for a moment and if both want to get apart go for mutual divorce or take a decision with proper distribution of asset if any.

Client Query My wife filed MC Bangalore and I filed for rcr and she filed dvc and got ex parte intrem Maintanence order and recently I got rcr ex party decree my side(husband). It's only a month Can I send a legal notice to wife to come and join matrimony home, also interim awarded to pay 10k, I am not paying since 1.5 years what will be the next procedure? 1.
