Moving out of house with child

Hi, I am Amarja from Pune, I have 7 years old son. I am looking to take divorce. Currently we are staying together. My lawyer has advised to move out of the house and then we can send notice. My husband is not letting me take my child with me and threatening me. He is saying I can move out alone. I want to know legal ways to take protection in order to move out with my child and the house stuff which belongs to me. nThanks,

firstly send a divorce notice to your husband. file a divorce petition aslo ask. your advocate to file a custody application for your child. under the Guardians and Wards Act, 1890 until. then take your child with you while. moving out from. your house.

Well, you should apply for Unilateral Divorce, considering, your Hubby will not agree to grant you Mutual Divorce. You should remain under the same roof in order to apply for the Unilateral Divorce with the child. Parallely apply for the Child Custody in the concerned Family Court.

Dear Queriest if you want to move out of the house with your belongings and child then you can take this step without his permission and once you take your child with you, you don't have to give custody of your child to him and let him take the custody through court for more information about the same kindly call me.
