Money given as gift in single operating account

23-Aug-2023 (In Divorce Law)
Can husband claim money given as gift (no gift deed) in single operated account of partner (not joint account) in the event of wife filing divorce case and is not asking for maintenance (both husband and wife are involved in extra marital affair, but husband has strong audio recording of wife and wife only has screenshots of WhatsApp chat)..Can husband reclaim the money from wife's account legally? And can he legally threaten wife to get the audio viral or if he does can his actions be penalised in court of law?

What both of you are doing is a moral wrong. If both of you have relations with somebody else then why don't part ways mutually without having feeling of hurting each other? Yes, indeed you aught not to viral the alleged audio with u. You may ask her to return the money, legally.

Dear queriest, if both of you are involved in extra marital affairs and even though you were not involved in marital affairs then also husband has no right to claim money, unless and until if he is not able to take care of himself by some means the court may pass such order, but in your case there is no right to him to claim or threaten you, for more information in detail kindly contact me.
