Misuse of women's rights by my wife and her family

Hi, I’ve been married for approximately four years. My wife is not staying with me and keeps finding reasons to go to her father’s home, even saying she doesn’t want to live with my parents. In these four years, she hasn’t stayed with me for more than five months at a time. We’ve tried to bring her back home, but she always gives a new reason. Her parents is also threatening to file a fake harassment case against me. Can i get divorce without paying maintenance?

Yes. You can do so. Two different applications and matters need to be filed in the same court. But it is possible to apply for urgent hearing and you may be granted interim relief from paying maintenance. yes you can get divorce without maintenance as it falls under under section 125(4) of Criminal procedure code/ 144(4) of Bhartiya Nyay Suraksha Sangita,2023 which is the exception where she refuses to stay with you
