Mental and emotional harassment by husband and inlaws

26-Aug-2023 (In Divorce Law)
I got married to a NRI. We had been into silly disputes throughout the year. I have been forced to quit 3 jobs in a year. And also forcefully asked to move with my parents. I have veen blamed by my in laws for been lying and on silly things that one will laugh if i say here. Now when i applied for my visa and finalised everything got my case file number my husband wants to separate. And also putting false allegations on me and my parents. Asking me to withdraw my file otherwise he will call embassy and put them in doubt that will ultimately lead to rejection of my case. He had been continuously told the wrong things by my mother in law. What case can i file on him. I m over with all this mental harassment that i was facing alone without any support from anyone. Should i contact woman commission or is there any way to call him back to India and cancel his visa.??

If you have stayed in domestic relationship with your husband and in laws for sometime then you can file a case of domestic violence against them for which they will receive a summon and will have to appear. Apart from this if you still feel that you can live with your husband then you should file a petition under section 9 of HMA for restitution of conjugal rights. Otherwise you can file for divorce under section 13 HMA. If he doesn't come to court despite service of summon then you can take an ex parte decree.
