I have completed four years of marriage and fifth year is going on . I stayed 4 months in my laws house. after three years my husband came finally in divorce case and he said neither he got the summons and nor he is working any more. Whenever any IO goes to their house it is all time locked. That means they are not staying in their house. The main cuprite MIL is died now. I am keeping unwell from the past 3 years .How would i get divorce & alimony from him ?

For alimony you need to file a Domestic Violence or a maintenance case under section 125 CrPC and claim your monthly maintenance. And if you are not interested in living with him anymore then rather stretching your relationship it's advisable to apply for mutual divorce and in that write down all your conditions regarding your stridhan or the lump sum alimony whichever is applicable in your settlement deed. For more legal assistance I am just a call away.
