Hello, regarding your question, it is a common and mandatory legal procedure in the Lucknow Family Court to refer a case to a counseling or mediation center before the formal trial begins. To understand the nuances of your case and prepare the appropriate legal defense, I recommend that you book a paid consultation so we can discuss this matter in detail. Yes, in matrimonial matters filed before the Family Court, the court generally makes an effort for reconciliation between the parties before proceeding with full litigation. Under the provisions of the Family Courts Act, the judge may refer the parties to mediation or counselling to see whether the dispute can be amicably resolved. However, mediation or counselling is not always a strict mandatory step before filing the divorce case. It is usually conducted after the case is filed and both parties appear before the court. If reconciliation fails, the court will proceed with the contested divorce proceedings on merits. Since the case has already been filed in the Lucknow Family Court, you should appear before the court and file your written statement/defence within the prescribed time and participate in mediation if the court directs.
