hello sir according to your query you can file divorce petition in nearest family court and you can file section 9 petition in nearest family court you can go to the nearest police station and file and FIR further more query please contact me I will suggest you what should you do

Yes You can file a divorce petition in the family court. on the ground of desertion. with respect to the custody of you daughter you can filed another application/petiton for the custody of child.
