30-Jan-2023 (In Divorce Law)
1. Filed MCD 13 B1 petition. Now in such a situation how to take original order and decree sheet copy after hearing. 2. What will happen after hearing the petition of 13 B1 will the court issue order along with the decree sheet or only an order copy will be given? 3. Whether the decree sheet will be issued separately along with the copy of the order in both the petitions 13B1 and 13B2. 4. Nowadays the court is closed, so how can a certified copy be taken from the court for other formalities, for example, withdrawal of the cases from magistrate court and quashing of FIR from Delhi High Court? 5. Is it necessary to file the original petition at the e-filing counter of the respective family court after e-filing the case? 6. Is Delhi High Court hearing 498a FIR quashing cases through virtual mode or not? 7. How long will this entire process take to complete once we start with e-filing of 13B1, 13B2, cancellation of FIR, and withdrawal of cases from magistrate court with virtual hearings?

Order sheets can be obtained by taking a Dasti order from the court. It can also be obtained from the reader to the magistrate. The whole set of petition is send to the other party. And after e-filing you need to file a hard copy also. And quashing is very much active in HC. For any other legal assistance text me.

1. A decree is issued only after the completion of the second motion and not the first motion. After the first motion you’ll just be given the copy of order regarding the completion of first motion. You can take that copy from the Ahalmad of the court concerned as the judge must have mentioned in the order that the copy he given to the parties. 2. After completion of second motion, the order regarding completion of second motion will be given to you then and there (if physical mode) and you can get the decree after few days. 3. Physical filing is required after doing tge e-filing. 4. As I’ve said, you may get the copy from the court itself so that ways there won’t be any problem in filing for quashing before the high court and yes the high court does take up quashing cases virtually as well. 5. In total it would take approx 6-7 months right from the filing of first motion uptil the quashing and withdrawal. However, if satisfied, the court may even Waive off the 6 months cooling off period between the two motions.

I’ll give you a summarised description of how it works and then you can take the call. Since FIR has been registered at the concerned police station so you should file a quashing petition in the High Court and that would solve major of the issues. I am advocate for Delhi Police and would guide you with the former one especially.
