Me and my wife were fighting cases against each other for the last 12 years. The details of fake / false cases filed by my wife 1)FIR 498a , 406,34 IPC 2). Domestic Violence 3).Divorce Case 4).CRPC 125. Further would like to confirm that we also have one daughter of 15 years due to which from the starting I am not interested in giving divorce and currently she is in the custody of my wife The details of cases filed by me are :1). Custody case 2).Section 9 RCR Case. Now currently I am getting offer from my wife side that she is ready to settled all the cases in addition to give her consent for quashing FIRs against me from HC through settlement of withdrawing cases against each other but subject to that she won't stay with me. Pls let me know that if i go for the above settlement can my wife later on apply for divorce on account of staying separately? Pls confirm what precautions to be taken in the settlement so that she later on can't apply for divorce or should I avoid settlement??

You need to sign up the settlement agreement in which all the terms and conditions should be written like any amount of money which needs to be exchanged between both of you or the custody of the child. And if you are legally divorced then she can’t file any further cases. For more legal assistance I am just a call away.

sir you can suggest your wife to go for divorce bg mutual consent.
this way you will be able to obtain divorce easily and to secure your interest you can get a memorandum of understanding executed wherein all terms and conditions of settlement will be clearly mentioned.

You should proceed for the settlement. If your concern is to stay with her / not stay with her. That is a separate issue. The important thing is that all false cases should be withdrawn. Divorce by mutual consent can be looked at later. Feel free to get in touch to discuss further.

there is no any law to prohibited your wife to not take divorce from you in future . it is better for you get settled your matter and and quase your FIR , and file mutual divorce with the consent of your wife
