While court ordering for interim maintenance ( ex-parte ) , court will consider some of facts like wife's education qualifications, assets and liability, other income , children age , salary of wife . Incase court ordered less amount you can go appeal .

Dear Madam, The Court has ample power to grant enhancement of interim maintenance if the amount already awarded is insufficient to meet basic living expenses. Interim maintenance is meant to provide reasonable support during the pendency of proceedings and should be realistic considering current cost of living, rent, food, medical expenses, and other necessities. If ₹6,000 is inadequate to maintain a dignified life, the aggrieved party can seek enhancement by placing on record the actual monthly expenses, inflationary costs, and the income and earning capacity of the respondent. Courts have consistently held that interim maintenance should ensure subsistence and not mere survival, and it can be modified if circumstances justify such enhancement.

Yes, you can file an application for the enhancement of interim maintenance in a divorce case. The court has the discretion to modify the amount if there is a proven, significant change in circumstances after the initial order was passed. Key Considerations for Enhancement Change in Circumstances: The primary ground for enhancement is a material change in the financial circumstances of either party since the original order was made. Examples include: An increase in the husband's income or assets. A rise in your living expenses or genuine needs. New evidence regarding the other party's actual lifestyle or financial status that was previously concealed. Serious disability or ill health of a dependent spouse or child requiring recurrent expenditure. Legal Provisions: You can move an application under relevant provisions of law, such as Section 24 of the Hindu Marriage Act, 1955, or Section 127 of the Code of Criminal Procedure, 1973, depending on which law the original order was passed under
