Marrying again without legally dissolving first marriage
10-Jul-2026 (In Divorce Law)
My wife married to me on 5th June 2023, and she had divorced her previous husband. i believed that and got married to her. but later on, i discovered that she didn't dissolve her first marriage legally and married to me. i also discovered that she deserted her husband just before he was taking time to recover from a injury to his head he got from a bike fall. i don't have any proof to prove her previous marriage existed except a jewellery bill with her marital name of previous husband on it.
If your wife's first marriage was not legally dissolved before your marriage, the legal consequences can be significant. However, a jewellery bill bearing her previous marital name alone may not be sufficient to establish that the earlier marriage was still subsisting. You should first obtain documentary proof such as the previous marriage certificate, certified copies of any divorce proceedings, or other official records before initiating any legal action.
Once the relevant documents are verified, you can explore the appropriate legal remedies available under the law, depending on the facts of your case. Please share your marriage certificate, the jewellery bill, and any other documents or information regarding your wife's previous marriage through the WhatsApp option on my profile for proper legal guidance and assessment of your case.
If your wife's first marriage was subsisting then your marriage is void. A jewellery bill alone is not sufficient proof, but it can be a supporting document. We can apply for certified copies of her previous marriage certificate, divorce decree, or other relevant document through the court where she applied for divorce. Based on the evidence, you may seek a declaration that the marriage is void and, if you want to initiate criminal proceedings for cheating or bigamy, you can do so.
Do not confront her or make allegations without evidence. Preserve all relevant documents and communications. As such matters involve complex questions of personal law and criminal law, consult an experienced family law advocate immediately to evaluate the evidence, obtain the necessary court records, and determine the most appropriate legal strategy based on your specific facts.
