Married in India, divorce in Australia

04-Oct-2023 (In Divorce Law)
I got married as per Hindu religion to a person who was in Australia. We have been married for 10 years now and have 6 yr old kid. Recently found he has been cheating on me for more than 3 yrs now. I'm a house wife and dependent on him. I'm still a permanent resident(he do not want to sponsor my citizenship). My hubby got Australian citizenship after my kid was born and my kid was born in Australia. Let me know how to proceed further? Should I come to India to file divorce? Or can I file from here? And I was tolerating his harassment (physical abuse and mental torture) thinking my kid needs a father. But now I feel we are better without him. I don't know any trustworthy person here to help me. He has a relative who is a lawyer, so he is making sure to trap me in such a way that I cannot get divorce nor confront him. I'm scared to do anything. Should I complain to police? I still love my husband. And I know adultery is not a crime in India nor in Australia. Kindly suggest. Thank you.

You can file a case from Australia but however before filing you have to take a concious call if u really want!! also try to resolve the matter amicably, if not then invoke your rights by filing a case.
