Married but loves someone else how to apply for divorce

i am a hindu and so is my wife. i am married to a woman and have a son with her but the marriage seems to be going through ups and downs and iv fallen in love with someone else. me and my wife are not married under Hindu Marriage Act, 1955, we only had a marriage in a temple. we have been living together for 3 years and i have a son with her. what all legal complications will i have to face if i have to leave her? she has my son, she can keep the son but can she put rape charges or any other charges on me? what will be the consequences and easier way to get out of this.

There is no easier way out of any such incidence which are against the law. First of is there any entry in the Register of the temple where you got married? 2. How you got married to her in the Temple. (Must be Love Marriage). 3. If it was Love then again you have fallen in love with some other lady. If such is the situation you will do the same thing with the other lady and this circle will go on, which is not acceptable by law at all.

She has your Son u said? Is the son only your's?? not her's.?

She can put charges of rape or not it totally depends on her.

If she put we can defend that

she can also put apply for Maintenance also

sir Have you registered your marriage? Since without legal marriage you can't have legal relationship with that person. With out valid marriage the marriage is void in eyes of law. She can put serious allegation on you.

Hello,
If you are married in a temple it means you have married her with all rites and rituals. You can seek a divorce from her. If she knows about your affair and is rely to divorce you, you can mutually get separated.

this information is too short to asnwer your queston. how old is your son? where you all are residing now? after leaveing your wife where she and child will be residing ? all these questions are very important to come out from situation.
