You should have to file divorce before Court , as you are married to her and marriage took place according to Hindu rituals at Arya Samaj Mandir, other wise she can file cases against you in various sections of law before Court.

Yes, if both of you have stayed for more than a year separately and thereafter you are looking forward to a divorce, there is a way to walk out from the marriage. There is a list of documents which would be required and are essential for moving before the appropriate court.

On the ground of cruelty: physical, emotional etc, a petition for divorce can be filed. There are some other grounds like conversion, adopting sanyas or mental sickness on which petition for divorce can be filed. You can also go abroad.

See where ever you go the marriage still exist. To get done with the marriage you have to get a divorce decree. Consult if you seek mutual divorce or even otherwise as the best legal solution can only be provided after knowing the state of mind of the wife.

You haven't provided necessary information. You have to clear reason for doing so. Have you got your marriage registeted or not. Try to sort out the diferences through mediation. If really don't want to continue meet and consult for the ways out of this.
