Marriage without Divorce & her husband make a case under section 494 ?

A woman is not married or not registered, under Hindu marriage Act 1955.
But, she did not divorce her husband and married someone according to Hindu marriage Act 1955,
so can her husband make a case under section 494 of ipc ?
if someone marries by way of saptapadi and does not wish to register the marriage but marriage is valid the second marriage without first divorce is null and void and hence 494 is valid and the wife shall be punished if all proof are given by husband
that will depend upon the case that the husband have made out but 494 is no more a crime.
now main thing is whether marriage was Solemanized as per hindu rites and rituals, if yes then again it is a valid marriage.
but she need not worried about that can also be taken care of in court.
