Maintenance to wife and objection on her petition on

can we file objection on wife's maintenance petition if the case is base less and she has never visited to your hometown after marriage. even she lived with you only for two days. can we file objection in higher court to dismiss her petition or should give objection in the same court

You need to pen down all your grievances in the form of a WS/reply and in that you can deny the fraudulent things that are written against you. And if some maintenance is decided by the court then you can get it waived off through section 127(2) on the ground that she's having sufficient to maintain herself. And if there's no scope of living together then rather stretching the relationship you should file for contested divorce under the ground of cruelty. I would suggest you to go with mutual divorce because it's cost effective and ends up in a maximum of six months. For more legal assistance I am just a call away.

You have to find the income of ur wife and whether she is able or not to maintain her in this way you can get rid of maintenance case you can fight with your grounds like she has no valid reason to live in her paternal home for further details plz free to call
