Maintenance in case of mutual divorce if i'm unemployed

My wife wants to settle for mutual divorce and currently I am unemployed. We have one daughter who wants to stay with mother. Do I have to pay for monthly maintenance etc . My wife is working and I am unemployed. Although I have bank balance but want to keep it for future emergencies and daughters higher studies.

yes you can go for Mutual Divorse.
With regard to maintenance under Sec 24 HM Act,Sec &/or 125 Crpc , you have to be creful while presenting your Petition U/S13 B of Hindu Marriage Act specyfying terms and condition and willingness of the wife to abide the same

You shall have to provide maintenance to your daughter for sure which can be shared with your wife. You don't need to provide maintenance to your wife if she earning adequately and her salary is not very less. moreover since the divorce has to be mutual you can discuss with your wife and come to a conclusion as in mutual divorces court cannot intervene to decide the maintenance . mutual divorce would contain terms with are con sensuously arrived upon.

Sir if you are both agree for the mutual divorce then there will be a MOU THAT will be signed by u both.. In CAse of mutual divorce it is between the parties to settle the monetary terms.. Court cannot ask you to give alimony if your wife does not want

hi,
settle the matter other wise your wife has many option to harass you, but if she is working then you can refuse to pay her and you can make an F.D for your daughter's future.....
