Maintenance in case of desertion cruelty by wife

Wife has filed cases 498A, 406,34 and u/s125 crpc simultaneously, u/s 125 interim order passed was of Rs.10000/- instantly, the family got acquitted u/s 498a,406,34 etc after long legal battle of 15 years on the grounds of cruelty, wilful desertion by wife supporting evidences is 1) handwritten statement of wife admitting cruelty by her and her family members, 2) Audio conversation of wife admitting filing of false cases and asking ransom of rs.1 crore for getting divorce, wilful desertion by speaking lies on many issues. Q. what is the legal help available to husband for false case and stopping maintenance?

Hi you have not disclose whether you have filed a divorce petition or a divorce decree has been granted to you by the court if not so than you can move to court citing quality as the ground for seeking divorce apart from that there are other grounds which we can discuss when you come to our office please free feel free to contact us thank you

You must have filed for divorce till now and if you have got the proofs like audio recordings you can always claim your rights. The remedy available for stopping maintenance is to show the income of the wife and showing your only office income.

If you have conclusive evidence than you must get the case registered under section 211 ipc and 500 ipc for defamation. Secondly, u have file suit for defamation n ask for compensation. Lastly, if your wife has not done Second marriage then u can’t stop her Maintainence, you can only genuinely delay it … or u need to file application to reduce her maintenance if you income has gone down with evidences, till the trail of maintenance case u can’t stop it
