maintenance for minor daughter

Me and My wife have divorced before 2014 and 2016 my ex-wife second marriage is done but he left my daughter with her ex-wife mother now he noticed me year 2014 to till date maintenance which are approximately 250000 but i am not go to court to paid and conditional warrant is issue against me. I am not be able to pay this amount so what I do suggest me and If i arrest then judge sending me to jail for 1 month or more than 6 month

The state has this law that father has to maintain his minor child and therefore pay monthly maintenance to him. If any person fails to do so on court order, the court can send him in jail for an initial for a period of one month and can increase the term until he pays the maintenance.

You need to attend the court proceedings on the next date of hearing and draft a reply/WS in your favour regarding the inability to pay the maintenance to your wife. And if your wife is working and is able to maintain herself then she will not be entitled to get any maintenance. For more legal assistance I am just a call away.

1. you have to pay the maintenance fixed by the court.

2. if maintenance is unpaid court can hold you in contempt and send you to prison for a period of 6 months.

3. try and negotiate a payment plan with opposite party.

You don't need to worry. People may claim anything they want. You don't have to pay to your ex wife for maintenance. You need to pay for your daughter and it should be as per your means. Also if your ex wife earns she also has a duty to jointly maintain the daughter. If you do not attend the court proceedings, it may happen that court will grant ex party order and order for attaching your property or whatever is claimed in the petition by your wife. So do attent the court proceedings don't miss out any dates.

court will send you to jail if you refuse to pay maintenance as fixed by the court.

not going to court will only make matters worse.

you can negotiate a payment plan with ex wife for payment of pending maintenance.
