Maintenance divorce dowry alimony fake 498


17-Dec-2023 (In Divorce Law)
Wife left matrimonial home by own(I have proof as her mom recording) , After this almost 1 year I tried to contact but she not replyed even not given response. She, her father & mother use abusive word to me ,So I filed Divorce case under section 13. Now she filed case for hefty maintenance, I don't want to give maintenance so what to do?

You need to identify the cause which led her to leave the matrimonial home. If there exists cruelty on her part and you are able to convince the court that her acts were cruel then her plea for maintenance can be dismissed by the court.

See, it depends on certain factors like is she earning or not, you both have any child or she is with someone else and so on. To understand properly and to proceed further there should be the whole story then only someone can direct you.
