Maintenance Demand on false grounds

14-Dec-2023 (In Divorce Law)
My son filed for divorce on grounds of cruelty. His wife filed a complaint in CAW citing dowry, domestic violence issues subsequently. Two other cases filed under DV act and sec 12 etc asking for maintenance amount of 35000/- and 125000/- in separate courts stating that she is unemployed. Now we have found out that she has been in continuous employment since separation.

If she had already filed it under her income affidavit that she is unemployed then she will be in big trouble because filing a misleading affidavit attracts penalties and imprisonment. It's all a matter of arguments in the court. It's advisable to file for a mutual divorce because it's cost effective and ends up in a maximum of six months.

In the cases where she has stated that she is unemployed, We can ask her to submit her income affidavit on oath. She has to file the details of her employment, if any with affidavit. We can produce the evidence before the court challenging her statements and further file cases for perjury for lying on oath before the court of law. Moreover, we can also challenge the amount that she is demanding before the court by providing such evidence.
