Maintenance and Child custody issue

Got married 2 years back, haviing a 1.5 yrs old baby. Wife left the house 6 month back as she was not willing to do household work ie preparing food, maintaning baby and didnt want to live with my oldage parents. she left the baby with me as well as was not interested. i m the only son and cant leave the parents as well. Parents are patients of Cancer and Heart diseases. Now today the sent me notice 125 of maintaince. since we dont ask her to leave and i have no job since 1 year, hence i am not ablle to pay her, she allso threatned me to take to baby from me. pls help. As she is not interested in child and she will give it to someone else, she is interested in money only. pls help..

please file a reply to the 125 petition. put forth all the facts stating that you are not in a position to pay the maintenance amount and that the wife is interested only in money and that you have no job, that parents are patients, etc.

you need to reply to the S125 maintenance case at the next hearing, under the same jurisdiction you should file a divorce case if both the parties are not willing to stay together. For the sake of your small baby, you can also approach and file conjugal rights to stay together and give a try to resolve the issues. Otherwise, a wife can file a domestic violence case or can file S498a anytime.
