Maintanence not being paid instead jurisdicton is being challenged

Hi I have got interim main ( in July 2021) My husband paid for 2 months then stopped. I approached court for execution in dec 2021 and got date of Jan 2022. Now I came to know that my husband has filed code of civil procedure sec 9 in Jan 2022. Is it possible to do it after paying for 2 months and after so many many months. What should I do

It must be section 9 of HMA which is Restitution of Conjugal Rights. If the court has ordered to pay you maintenance then he is duty bound to pay you. Execution can be filed anytime. On the next date address the judge that he had failed/stopped payments after 2 months and try to pass an order for attachment of property or account of your husband.

First file for a contempt against your husband in the Hon’ble High Court which is punishable with imprisonment of 6 months. This shall ensure that your husband will have to abide by the orders of the Hon’ble Court.
