Maintanence bof child by father

Hi I got an ex parte divorce around 5 years ago later on by ex spouse has been visiting and staying with us now and then to meet our children whereas, no monetory responsibility has been taken care by him. Kindly advice if the divorce can be set aside since he has been staying with us post divorce as well. If not, can I claim for child maintenance, in that case how much can I claim for my 2 children. Will the children age too will be considered here. Kindly suggest.

Claim for maintenance of children can be filed as a separate case. Ex spouse staying with you is not an impediment for claiming maintenance. Maintenance amount depends on expenses related to education, living, upkeep, etc. Age of the children is also a factor.
