Lower court asking to provide current status on stay of Allahabad high

Dear Sir/Madam Before Corona (Nearly two years back) Allahabad high Court put stay on my 125 and DV interim maintenance separately (under section 482) and send my cases to mediation court. Meditation fails between me and my wife and mediation centre submit their report back to court nearly one year back. now lower court judge asked us what is the status of the stay of High Court . Both 125 and DV case Files is not coming on date for hearing in Allahabad high Court. pls suggest me what should i do or what is my next step as i don't want to pay maintenance to my wife, no baby born between us, she is able body highly educated M Pharma.... have 30 lakhs in her saving account....
If the behaviour of your wife is intolerable towards you then you can always file for divorce. That’s just a matter of arguments in the court and you can also file your written statement that she is capable of maintaining herself and doesn’t require any maintenance. Have she deposited her bank statement and ITR .You must request the court to direct the respondent to produce her relevant documents . I think your stay is going on in High court . u just apply the certified copy of last high court order and submit the order lower court.

You please see the last order of the High Court and confirm the status to the court. Mediation failed but from your query it seems that no order for vacating the stay has been passed by the High Court that means effectively stay is still continuing. If she is highly educated, have the capacity to earn and have huge amounts in her banks that these points needs to be put forth before the court in 125 case and DV Case

You need to talk to your advocate to file application at AHC with intimation that mediation got failed therefore case must again be referred to lower court for further proceedings …if your advocate isn’t working in this then take second opinion..thanks
