you can file a case for divorce on the grounds of cruelty and along with the said case you can file a separate case claiming maintenance. you can also file an FIR against your husband and his family in the CAW cell. filing of the case and the other proceedings will depend on the jurisdiction aspect as well. for further queries please feel free to contact

In divorce it becomes difficult to fetch out the maintenance or the alimony. You need to file a separate case like Domestic Violence or an application under section 125 CrPC for the grant of your monthly maintenance. You should attach your medical data also along with your file. For more legal assistance I am just a call away.

Section – 13(1)(ia) of Hindu Marriage Act defines cruelty as wilful and unjustifiable conduct of such character as to cause danger to life, limb or health, bodily or mental, or as to give rise to a reasonable apprehension of such a danger. The situations that you have experienced have left you unwell with many diseases. Such a person cannot be expected to work and maintain themselves. Therefore you can file for divorce on grounds of cruelty and dowry harrasment.
