Living with another person before divorse

18-Oct-2023 (In Divorce Law)
Wife wants to leave home as if found, will b tortured and blackmailed by husband and relatives including her own blood relatives. She wants to first flea from house and then file a divorse as of now she is kept in four walls against her will. I want to confirm if she runs away with another person whom she is gonna marry in future and stays with him and his family while filing divorse. Is there any legal problems to wife or that person with whom she is gonna live.

Dear queriest, as per Latest Supreme Court judgement it has been declared that Section 497 is unconstitutional. Adultery is not a crime. As you are not willing to stay with your husband you can file for divorce and also you have the right to live your life by your own way. There be no legal problem as asked by you in future

This is my response to you:
1. Ask her to leave the house;
2. Tell her to file for divorce on grounds known to you example cruelty etc.;
3. She may face a little difficulty because the husband will bring up that issue in court;
4. Though the person whom she runs away with cannot be arrested, as per SC Judgment few days ago;
5. Consult a local lawyer and go ahead with the same.
