I am married since 7 years and have a 6 year old kid. Me and my wife don't stay together in the same room since 6 years but we stay in the same house. We dont talk to each other either. Het brother is a police officer and whenever we fight, she threatens. I want to file a divorce as we are unable to sort out things since so many years. She approached a lawyer few years back but my parents stopped her and now i want to file a divorce but my parents are stopping it again because of the fear of her brother. yes you can file petition for divorce under the circumstances you have mentioned. there will be issue regarding her maintenance and custody of minor also that you need think about. you have mentioned that her brother is a police officer, that will definitely create problems, but again police has limited scope in matrimonial disputes.

separation under one roof can be proved on merits.
