Having a relationship with a person who is still legally married can attract complications under matrimonial laws. If the man has not yet obtained a final divorce decree from the competent court, such a relationship may be seen as adulterous under Section 497 IPC (now omitted but still relevant in civil matrimonial disputes) and can be cited as a ground for cruelty or adultery in divorce proceedings. However, if he has legally completed his divorce and the decree is final, there is no criminal liability or punishable offence. Still, for safety, verify the certified copy of the decree from the Family Court to ensure the divorce is final and not under appeal.

Being in a relationship with a married man is not a punishable offence under Indian law. The offence of adultery under Section 497 IPC was struck down by the Supreme Court in Joseph Shine v. Union of India (2018). Hence, no criminal case can be filed against you for such a relationship. However, if the man’s divorce is not yet legally finalised, he is still considered married in the eyes of law. In such cases, though you cannot be punished criminally, his spouse may use the relationship as a ground for divorce or allege mental cruelty in family court proceedings. Once his divorce is complete and final, there is no legal restriction on being in a relationship with him. Still, such situations can carry social or moral complications, so it is advisable to ensure that the divorce decree is final and duly certified by the court before continuing the relationship. Conclusion: You are not punishable, but confirm that his divorce is legally completed to avoid any future legal or personal issues

If the man has legally completed his divorce ? However, if the divorce is not yet finalized and he is still legally married, then it could raise moral or matrimonial issues, but not a criminal offence, unless it involves cheating, coercion, or false promises. If you wish, I can help you review the divorce documents and guide you on maintaining full legal protection in your relationship.
