Questions Answered by Advocate Kurada Krishna Prasad

Q: Brokerage disputes after the deal landlord is refusing full payment

I was engaged For lease facilitation of a property. And I did complete the facilitation by getting client and closing the deal and had all communication on WhatsApp about certain fee and from the beginning he had wrong intent and did not allowed me to formalise it by any contract or invoice ever after repeatedly asking for one as I made 10 visits to his place during the process. And now when he received advances and property is in possession of the tenant the landlord is refusing any agreemement

Advocate Kurada Krishna Prasad answered
Based on your statement, you were engaged for lease facilitation and successfully completed your part by introducing the tenant and closing the deal. Even though no formal written agreement or invoice exists, your WhatsApp communication, property visits, and any other digital or verbal exchanges serve as valid evidence of a business understanding under the Indian Evidence Act, 1872.You may be entitled to your facilitation fee under the principle of quantum meruit (Section 70, Indian Contract Act, 1872), which protects a person who has lawfully provided services with the expectation of payment. Before proceeding legally, please clarify:1. Do you have WhatsApp messages or other records clearly showing the agreed fee and acknowledgment of your role?2. Was any advance or partial payment made to you?3. Are there witnesses or other proof of your visits and role in finalising the lease? If evidence supports your claim, you can issue a legal notice demanding payment, and if unpaid, file a civil suit for recovery of your facilitation charges. Conclusion: You have a valid claim in law; gather all evidence and serve a formal legal notice to the landlord immediately.

Q: living relationship with married man

may be punishable if in relationship with married men . He did complete his divorce

Advocate Kurada Krishna Prasad answered
Being in a relationship with a married man is not a punishable offence under Indian law. The offence of adultery under Section 497 IPC was struck down by the Supreme Court in Joseph Shine v. Union of India (2018). Hence, no criminal case can be filed against you for such a relationship. However, if the man’s divorce is not yet legally finalised, he is still considered married in the eyes of law. In such cases, though you cannot be punished criminally, his spouse may use the relationship as a ground for divorce or allege mental cruelty in family court proceedings.Once his divorce is complete and final, there is no legal restriction on being in a relationship with him. Still, such situations can carry social or moral complications, so it is advisable to ensure that the divorce decree is final and duly certified by the court before continuing the relationship. Conclusion: You are not punishable, but confirm that his divorce is legally completed to avoid any future legal or personal issues

Q: Police Verification Market not Clear

This is for my daughter. She is 18. Rest of the family got our renewed passport. My Daughters police verification is marked as not clear. Reason- Her Mothers name has Initials of her Father in Marksheet ( Sita A R Sharma ) and in daughters application is mentioned mothers name as Sita Sharma. I dont understand when passport office it self are okay - why is police doing this clerical work instead of criminal and citizenship check.

Advocate Kurada Krishna Prasad answered
I understand your concern. This issue is quite common during passport verification. The Passport Office verifies documents for eligibility, while the police conduct a separate check to confirm the applicant’s identity, parentage, and address. In your daughter’s case, the difference between “Sita A R Sharma” in the mother’s documents and “Sita Sharma” in the passport application has led the police to mark the report as “not clear.”Although the Passport Office often accepts such minor variations, the police are required to report any discrepancy exactly as seen, to avoid any future accountability issues. It is not about criminal suspicion, but a procedural safeguard. You can resolve this by submitting a written clarification or affidavit stating that both names refer to the same person, along with supporting documents like Aadhaar, PAN, or a marriage certificate. The Passport Seva Kendra can then reinitiate police verification. This is a routine issue and once clarified, the verification will generally be cleared without further delay.

Q: Advocate Blackmailing Issue - How to deal ? Advocates Please help?

I called an advocate I found on Google to ask if he could take a specific case. Instead of answering, he recorded the call without consent, took my details, and dragged a 1-hour conversation. Now he’s demanding ₹10K for consultation, even though he’s 100 km away from Hyderabad. If I don't give him he is threating he will share the conversation to opposite party. This is related to a divorce case question whether he can take up or not. What can I do to protect me in this case ?

Advocate Kurada Krishna Prasad answered
You don’t need to worry. What that person did is completely wrong and unethical. Recording a call without your permission and demanding money for it is not legal. You can take these steps to protect yourself:1. Do not pay him anything. There is no valid consultation agreement between you both.2. Keep all proof — like call records, messages, and screenshots — safely with you.3. Send him a warning message (preferably on WhatsApp or SMS) stating that he has no authority to demand money and that sharing your personal conversation without consent amounts to harassment and violation of privacy.4. If he continues to threaten you, file a police complaint for criminal intimidation and harassment. You can also approach the Bar Council against him for professional misconduct. If you want, I can help you draft a proper written complaint or message to send him.
