Live in relationship without divorce

I am a Hindu, living separately from wife for 4 years. Married 9 years back. I have a daughter of 5 years living with her mother. Wife works in public sector bank. Filed for Restitution of Conjugal Rights (RCR), but I don't want to live with her. All the efforts of mutual divorce are failed. What if I live in relationship with a woman, what are the consequences? What if I secretly marry and pretend living in relationship? what would be the alimony if wife finds out living in relationship?

You can continue with your live-in, however, it would be illegal to get married during the subsistence of your first marriage. So you should not get married. As far as alimony is concerned, you cannot escape payment of the same unless you can show that your wife can maintain herself. Dear client based on your question, Since you are still legally married and have only filed for RCR, you continue to be the lawful husband. Separation without Divorce does not dissolve the marriage. Well, if you get married secretly without seeking a Divorce from your first wife, it may happen, that, once she comes to know about it, she may file a case of Bigamy against you, which is Criminally punishable.

Once a man is married under Hindu marriage act, he is bound by the law to maintain fidelity unless the marriage is legally dissolved through Divorce. The Live in relationship can also be treated as Bigamy in your case. My suggestion would be if mutual consent divorce is not working out, You can file for contested divorce and get the matter sorted.
