Live in relationship or Bigamy if they have child,will bail be allowed

My husband deserted and abandoned me and my daughter. He filed a conjugal rights, said I didnt turn out to live with him and now filed a divorce. Meanwhile he is with another woman and they now have a daughter. I took evidence of that kid and filed bigamy case and FIR is files. Now for AB, they appeared and said they were in live in relationship and have a child but not married. So no bigamy is made out and they claim for AB. Will AB be allowed? Won't they be punished for this? Won't this be presumed to be marriage?

Nowadays, courts are of the view that live in relationship is as good as marriage. Granting AB is not an end. It's just an interim arrangement against arrest. In my view, the court might consider that the live-in partner and her child should not be deprived of support from your husband. You can concentrate on prosecution and compensation.

you should also check the ration card whether that lady was given husband as your husband name and voter ID and other relevant documents in which the birth certificate is that the girl's father and mother for marriage it is not necessary to prove that they have been buried but they are living as an husband and wife then it is equal to marriage only
