Legal seperation from husband with child custody on mental/verbal abus

my daughter wants legal seperation from husband on mental and verbal abuse for a long time. she is alreadyn living with me with her daughter for a month now. What financial rights can she claim from him to maintain herself and daughter?

firstly i would like to inform you no court will pass an order to husband who has a genuine ailing wife, moreover yes court will grant a good maintenance for both the mother and child if court is firmly informed of the tortured meted upon the wife, there is a way to justice and the husband and his family should be taught a lesson

I'm sorry to hear of this ordeal that your daughter is going through. as a legal professional we are always delighted to provide relief to distressed individuals and this time the legal provisions are straight and simple. first you should have some evidence of the ill treatment being meted out to her which can be equated to cruelty. once this is done then the next step would be filing for a contested divorce under the act under which the marriage was solemnised. in case the evidences are not overwhelming then you can start by filing a case of judicial separation and after the same is granted and one year without cohabitation expires your daughter can file a case of divorce thereafter.
