In simple terms, accessing or hacking someone's WhatsApp without their permission is illegal, and evidence obtained this way can be strongly challenged in court. ​Challenge the Evidence in Family Court: You can file an application stating that the WhatsApp chats were obtained illegally by violating your fundamental Right to Privacy. Under Indian evidence laws (Section 65B of Evidence Act / Section 63 BSA), electronic evidence requires strict proof of lawful custody and valid electronic certification. ​File a Cyber Crime Complaint: Hacking or accessing another person's WhatsApp/mobile device without consent is a punishable offense under the IT Act (Sections 66 and 66E), carrying penalties and imprisonment up to 3 years.

The wife can prove it by showing how the photos were illegally obtained , rather than voluntarily shared . She has to prove the original device , screenshots , login alerts , messages and other digital evidence . Illegally obtained chats cannot be used as proof. If those chats were taken from your phone without your permission, it cannot be used as evidence in the court. We can always oppose that. They cannot prove adultery by using that evidence. We can oppose that in the court. So, it's not a problem.
