Jurisdiction of divorce - please advise if can file in Mumbai

31-May-2024 (In Divorce Law)
We are Goan Catholics, court married in Goa as per Goa and Portugese code. Can we file for divorce in Mumbai? My spouse's advocate says it needs to be done in Goa to cancel the registration in Goa. Please advise, as I am born, raised and currently live in Mumba. Also, if they go for one sided divorce, will I get a copy of the divorce certificate at the end and can I collect my gold from his house after that?

If you want to file a Unilateral Divorce Case being a Catholic Goan, who got married in Goa as per the Portuguese Code, then, you cannot directly file a case in Mumbai. You have to first file a case in the concerned Family Court of Goa to seek Unilateral Divorce as per the Portuguese Code. If things don't go in your favor, then, you can file an Appeal before the concerned Goa Bench of Bombay High Court. If you want to seek Mutual Divorce with your Spouse, then, being Goan Catholics, you have to seek Divorce in Goa as per the Portuguese Code before the concerned Family Court. You cannot seek Divorce in Mumbai.
