Judge did ex parte the domestic violence case

05-Apr-2024 (In Divorce Law)
Hindu - I filed a domestic violence case against my husband and mother-in-law. After a few hearings and two years, judge has ex parte the case in my favour because their lawyer was not able to submit the reply and in the last hearing they did not even appear in the court. My question is what is going to happen next can they appeal against ex parte? I have 2 other cases: 1 for maintenance where they have not filed the reply for last two years and 1 more case where my husband has filed for divorce

you had your advocate who is fighting your case. so you should consult your own advocate. moreover if you feel like to take a another route then you should tell the complete story of your case to get accurate legal opinion

The opposite party can appeal against the ex-parte order within 60 days of the pronouncement of the order. And if there's no scope of living together then rather than stretching the relationship you should go with mutual divorce because it's cost effective and ends up in a maximum of 6 months. For more legal assistance I am just a call away.

Certainly, they have the right to appeal against the ex parte order. The appeal must be filed within 30 days in a domestic violence case. Once they file the appeal, the court will summon you to file a reply and subsequently present arguments on the matter.

Application is filed to set aside the ex parte order . About the other pending cases : if they haven't filed the reply for last two years in this I will suggest that you must hire a good legal practitioner , as per your information your husband has filed a divorce case : it depends on which ground they have filed the divorce case .
