Joint Declaration suit for Declaring Marriage null and Void

The marriage was conducted as per Hindu rites and ceremonies. However it was not legally registered. Not resided together. Now both husband and wife doesn't want to continue relationship. Is it possible to file a Joint Declaration suit for Declaring Marriage null and Void?

can file a petition seeking declaration as marriage bas null and void before the family court having jurisdiction or else, both had to file petition seeking mutual divorce and in the alternative, as marriage was not registered and only ceremonies alone were performed, both could consider the situation as nothing done in the past

No, you can file divorce petition. Null and void can be filed in special circumstances otherwise divorce petition have to file. you can file a mutual divorce petition. If you are mentioning the reason for separation.

yes, First you have to obtain a marriage certificate from the temple which you conducted the marriage ceremony if it is not conducted in a temple please let me know. you can file mutual divorce before the family court.
legal registration is not needed.
