Dear Sir, The father can file a petition for custody / joint custody / visitation rights under the Guardians and Wards Act, 1890 and also seek appropriate orders in the pending divorce or family court proceedings. Courts in India increasingly recognize shared parenting and grant joint custody, shared custody, or at least extensive visitation rights, especially when the child is above 5–6 years and the father is capable, caring, and involved.
