Is transfer petition essential, and costs a lot?

27-Jan-2024 (In Divorce Law)
I have filed divorce case from Bangalore in dec'23 but after receiving notice (we have been living separately past 6-7 months) my husband filed conjugal rights case from aligarh in Jan'24. I have solid reasons for living separate and asking divorce. Do I need to fight the case file by him. I can't travel to aligarh, what happens if i don't appear? Is it essential to get it transferred to Bangalore?how much time and money is involved? My divorce case hearing is in March, after aligarh's date

Dear Madam, You have to contest the RCR case at Aligarh otherwise it may be decreed ex parte. Furthermore you may file section 10 CPC application to stay the proceedings in RCR as it is filed later to your case. Otherwise you may file transfer petition in Supreme Court.
