Based on your facts, police summons through SMS or email alone is not considered a valid mode of service under law. A proper summons must be issued by the court or investigating authority in writing and served through due process. If your wife has filed a false complaint, you may challenge the same before the High Court by filing a petition under Section 482 Cr.P.C. to quash the FIR or complaint. Since you are residing overseas, you can appoint a lawyer in India with a Power of Attorney to represent you and take necessary steps. Ignoring the summons may lead to coercive action, so it is advisable to respond legally instead of avoiding it. You may also initiate appropriate divorce proceedings on grounds of cruelty and false allegations.

Hi there, summons by sms/whatsapp/mail are now valid in India. Instead of going for Quashing of summons you should participate and find out exactly what case is made against you. Once you have all the details then you should do for Quashing of the case itself/ file discharge application, etc. It's advisable to contact me and provide more details to assist you better.

The summons cannot be treated as valid if merely sent by SMS/WhatsApp/email, as service must be in accordance with law. However, since you are living overseas, the matter requires careful handling to avoid adverse orders. It is advisable to appoint a lawyer in India to represent you, seek certified copies of the complaint and summons, and move appropriate applications before court. Please connect with me directly so I can guide you step-by-step in defending the false allegations and protecting your legal rights.

SMS/email alone is generally not valid service unless ordered by court. But you should not ignore the case. Best course is to let your lawyer in India verify the summons, file for exemption from appearance, and if needed, move to quash the case. Also did you receive notice from the police or summons from the court?
