Is SLP valid filled after 5 months of divorce decree.

Hi, Is SLP valid filled after 5 months of divorce decree? However husband got remarried after completing the 90 days limitation period of appeal . Kindly suggest .

One can get remarried after the 90 days limitation period expires. However, if you wish to challenge the divorce decree even after expiry of the limitation period you must first approach the High Court first before approaching the Supreme Court vide SLP directly. Well, as you have not challenged the final order of the lower court within a prescribed limitation period and such by taking advantage of it, your Husband got married with any other woman, so now, you can do anything against your Husband except on few grounds, which need to be proved in Court

SLP can only be filed in the Supreme Court. If there is a delay in filing such SLP the same needs to be condoned. The appeal from the judgement passed by any Family Court lies before the respective High Court. Considering the above, SLP would not be maintainable in SC. Even though a party remarrying post appeal period doesn’t make the appeal infructuous.

Need more details on what kind of divorce decree is passed When is the limitation period gets over is to be seen If someone voilates the limitation period by marring second time can be proscecuted Feel free to call
