Is Reconciliation possible in mutual divorces ? will the court helpme

We had filed for a Mutual Divorce 7 months back, 1st session on counselling was done by the court, now we have to go for final hearing in Sept, i want to reconcile, as i need to make this marriage work. Is that possible ? what if my husband denies

Yes, you can still seek reconciliation if the mutual-consent divorce decree has not yet been passed. Since both parties’ consent is required at the final stage, you can withdraw your consent and inform the Family Court that you want to save the marriage and seek counselling/mediation. However, if your husband refuses reconciliation and withdraws his consent, the mutual-consent divorce cannot proceed, though you cannot legally force him to continue the marriage.

yes, mutual divorce petition filed by you along with opposite party that is joint petition you any time withdraw petition or not willing to proceed further eventhough your husband denied, discuss your lawyer take necessary steps

Yes, reconciliation is legally possible at this stage. Since your final hearing/second motion is still pending and the divorce decree has not yet been passed, you can inform the Family Court that you have reconsidered your decision and wish to continue the marriage. However, reconciliation requires both spouses to agree to continue the marriage. If your husband also agrees, you can jointly request the Court to close/withdraw the mutual consent divorce proceedings. If your husband does not agree and insists on divorce, you cannot force him to reconcile. However, equally, he cannot obtain a decree of divorce by mutual consent without your continuing consent. The Supreme Court has consistently held that mutual consent must subsist until the divorce decree is passed. Therefore, before the September hearing, you should communicate your intention clearly and, if possible, try counselling/mediation to see whether both of you can work on the marriage

If you want to reconcile you need to communicate this through your advocate, to the husband if he is ready you can go to the court and say that you need to give this marriage One Last chance to the marriage and tell the court, or directly talk to husband for reconciliation

on the next date, you can put an application to the court that you no longer want to proceed with the mutual divorce and want to give reconciliation a chance. if husband refuses, it will become a contested divorce and a trial will begin. The court will send you both for mediation again and you try your luck there. You can also file a restitution of conjugal rights petition to seek reconciliation
