Is Khulanama and award copy of Lok Adalat Sufficient for divorce-proof

Hi, In the process of dissolving my marriage, I have already obtained a Khulanama from H'ble Qazi and we are in the process of approaching Lok Adalat to withdraw all the cases filed against me and my family. Now the question remains whether I should still approach Family court and apply for a divorce or if the Khulanama and the award copy to be issued by Lok Adalat are sufficient for my family to be "safe" from them. An agreement was made for withdrawal of cases which included details of money towards permanent alimony and maintenance; but I had to ask this question because I don't trust my ex-wife at all. Thank you all for your time. Kindly advise.

Yes it is ok if an agreement is made to that extent. However we have to cross check as to what are the conditions made in the agreement between both the parties. Khula is that she is separating but parallel you have to check about the cases to be withdrawn first then you can sign and accept her khula. Call us through the website

Its advisable to approach Lok adalat, as the compromise terms will be recorded before lok adalat and an Award will be passed which is equal to a Decree. Because it ensures that the parties do not back out thereafter. No need to obtain divorce separately as the Khulanama is sufficient proof of divorce under Muslim law.

Khulanama and award copy issued by lok adalat is safe from the point of both parties reaching mediation.
However each of the cases filed by your ex-wife has to be dismissed by respective courts as not pressed and for that, you will need to submit the certified copy of khulanama and award copy to the respective courts.
