Interrogatories as per CPC are not directly applicable in DV Act CrPC proceedings since they are summary in nature. However, courts have held that the Magistrate has full discretion to permit limited questions or cross-examination if it aids fair adjudication. Supreme Court and various High Courts have clarified that such flexibility is within the court’s power, though it is not a matter of right. interrogatories are not routinely allowed in 125/DV cases, but the court has discretion to adopt them to ensure justice. You may rely on Savitaben Somabhai Bhatiya v. State of Gujarat (2005) 3 SCC 636 and similar High Court observations to support your plea.
