Interim n permanent Maintenance

04-Aug-2023 (In Divorce Law)
Before marriage suppred her job. Later she wants to continue the job & she prefers job than family. 5 years ago left home volunterily when nobody was in home. She mentioned my income 40000 pm, but I am a retired person. Now filed 125 crpc where mentioned no income. Later confessed her job in court. In this case is it mandatory to pay maintenance?

if she has concealed or made false declaration on oath or affidavit then obviously action lies against her. you also can challenge her maintenance based on her conduct and particularly her income. it's not mandatory to pay maintenance under certain circumstances. regards, Tanmoy Chattopadhyay, M.Sc (Net), LL.B (Delhi University), Advocate, Hon'ble High Court, Calcutta.
